DUI Penalties In Indiana
Penalties for a DUI can become harsher with the more offenses an individual has. When an individual is arrested for their first OWI offense, their penalties generally won’t be as harsh as someone who is facing their fourth offense. Depending on your prior offenses, you could face harsher punishments for your DUI:
- First offense: you could face 60 days to 1 year in jail, $500 to $5,000 in fines, and license suspension for up to 2 years
- Second Offense: you could face 5 days to 3 years in jail, $10,000 in fines, and 180 days to 2 years of suspension on your license
- Third offense: you could face 10 days to 3 years in jail, up to $10,000 in fines, 1 year to 10 years of suspension on your license and a court-ordered ignition interlock device
Some people will refuse to take a chemical test, in an attempt to avoid DUI charges. If you refuse to take a breath or blood test, you can still be penalized and charged with a DUI. Refusal can result in fines and license suspension.
